Clause n° 1 : Object

The following general conditions of sale detail the rights and obligations of Maopika and its customer in the context of the sale of the following goods: Silicone molds, clay cutters...
Toute prestation accomplie par la société Maopika implique donc l’adhésion sans réserve de l’acheteur aux présentes conditions générales de vente.

Maopika reserves the right to modify its sales conditions at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer. 

Clause n° 1 : Produits

All the items are entirely handmade, by Maopika. There may be some imperfections, each product being made to order, there may be slight differences for the same product or compare to the photo (size, shape, shaker elements ...)

Also, the colors may come out slightly different compared to the photos (no filter is used on the photos).

Each article is presented by a detailed description with all the important information, by buying a product the customer agrees to have read the descriptions of the ordered products.

Clause n° 3 : Prix

The prices of the products sold are those in place on the day of order taking. They are denominated in euros and calculated including all taxes. Nevertheless, the transport costs will be applicable on the day of the order and will be charged to the buyer in addition. Maopika has the right to modify its prices at any time. However, it commits itself to invoice the goods ordered at the prices indicated when the order is registered.

Clause n° 4 : Commandes

The buyer, who wants to buy a product or a service, has to :

  • Fill out the ID card on which he will indicate all the contact information requested or give his customer number if he has one.
  • Confirm his order after checking it.
  • Carry out the payment in the terms and conditions specified.
  • Confirm his order and payment.

Confirmation of the order implies the acceptance of these terms and conditions of sale, the acknowledgement of having perfect knowledge of them and the renunciation to avail oneself of one's own terms and conditions of purchase or other conditions.

All the data provided and the confirmation recorded will be considered as proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.

The seller will communicate by e-mail confirmation of the registered order.

Maopika reserves the right not to record a payment, and not to confirm an order for any reason whatsoever.

Clause n° 5 : Modalités de paiement

The payment of the orders is made :

Any confirmed order is considered fixed and final.

At the buyer's request, a paper invoice will be sent to him, without this request no invoice will be included in the package. This one will remain digital.

Clause n° 6 : Livraison

Delivery is made to the address indicated by the buyer at the time of the order.

The delivery time indicated when registering the order is given only as an indication and is in no way guaranteed.

Consequently, any reasonable delay in the delivery of the products will not give rise to the benefit of the buyer to :

  • the awarding of damages;
  • cancellation of the order.

The risks are borne by the buyer from the moment wen products have been collected by the carrier. In the event of damage during transport, a justified protest must be made to the carrier within three days of delivery.

In case of lost of the package, the buyer must inform as soon as possible the company Maopika which will take care of the resolution of the dispute. 

Clause n° 7 : Garantie fabricant

All products supplied by the seller are covered by the legal warranty.

In case of a defect on a product sold, it can be partially or totally refunded if the defect prevents the use of the product. In case Maopika decides to send a new product, the defective product will have to be sent back to the seller to exchange it. The defective product will have to be sent back as it was received (clean product, careful packaging...), otherwise the seller can ask for a compensation.

All claims, requests for exchange or refund must be made electronically to the following address: contact@maopika.com within thirty days after delivery.

Maopika cannot be held responsible for any damage resulting from misuse.

Clause n° 8 : Rétractation et retour

You have a period of 14 working days from the order delivery date to return any item that doesn't suit you, in its original packaging and in perfect condition, suitable for its re-marketing and ask for an exchange or refund without penalties, except for the return costs. The following items cannot be returned or exchanged

Due to the nature of these items, unless they arrive damaged or defective, I cannot accept returns for :

  • Custom or personalized orders
  • Promotional items

Clause n° 9 : Taxes de douanes et d’import

Any customs fees and import taxes are the responsibility of the buyers. The company is not responsible for delays caused by customs.

Clause n° 10 : Médiation

Any dispute relating to the interpretation and execution of these terms and conditions of sale is subject to French law. Any dispute or claim must be made to our customer support at this email address contact@maopika.com in priority to obtain an amicable solution.

In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, the company has set up a mediation system for customers.

The mediation entity chosen is: CNPM – MEDIATION – CONSOMMATION.

 The seller, in the process of selling online, is only bound by an obligation of means; its responsibility cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service rupture, or other involuntary problems.

All the elements of the Maopika website are and stay the intellectual and exclusive property of Maopika and its manager Marie Allardon.

No one is authorized to copy, exploit, redistribute, or use for any purpose or whatsoever, even partially, elements of the site, be they software, visual or audio. Any simple link or hypertext link is strictly prohibited without the express written consent of Marie Allardon.

Clause n° 13 : Langue du contrat

The present terms and conditions are written in French. In case they would be translated into one or more other languages, only the French text would be valid in case of conflict.
