Clause n° 1 : Object

These general terms and conditions of sale (GTC) define the rights and obligations of Maopika and its private or professional customers in connection with the sale of the following products: silicone molds, clay cutters, and supplies for crafting.

Any order placed on the website implies unconditional acceptance of these Terms and Conditions.
Maopika reserves the right to modify its Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date of the order.

Clause n° 2 : Products

All items are handcrafted by Maopika. They may therefore vary slightly or have minor imperfections compared to the photos (size, shape, colors, decorative elements, etc.).
Each product is accompanied by a detailed description. The customer recognizes having read the essential characteristics of the product before placing their order. The choice and purchase of the product is their sole responsibility.

Clause n° 3 : Prices

Prices are displayed in euros, inclusive of all taxes, excluding delivery costs, and are valid at the time of ordering. Maopika reserves the right to change its prices at any time, but orders will be invoiced at the price displayed at the time the order is placed.

For orders to the United States, a 15% VAT is automatically added to the products and shipping costs and is visible in the shopping cart and order confirmation.

Clause n° 4 : Orders

To confirm an order, the customer needs to:

  • Fill in the identification form with contact details,
  • Check and confirm the shopping cart,
  • Make the payment according to the terms and conditions,
  • Confirm the order.

Confirmation of the order implies acceptance of the Terms and Conditions and serves as proof of the transaction.
Maopika reserves the right to refuse an order in the event of a previous dispute, payment issue, or for any other legitimate reason.
All the data provided and the confirmation recorded will be considered as proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.
Maopika will send confirmation of the registered order by email.

Clause n° 5 : Payment

Your transactions are encrypted and your banking information remains confidential.
The payment of the orders is made :

  • Or by credit card;
  • Or by Paypal

Any confirmed order is considered fixed and final.
At the buyer's request, a paper invoice will be sent to him, without this request no invoice will be included in the package. This one will remain digital.

Clause n° 6 : Delivery

Delivery is made to the address provided by the customer when placing the order. The customer must provide a complete, accurate, and verifiable address. In the event of an error, omission, or incomplete address, Maopika cannot be held responsible for a failed delivery.

  • If the package is returned to Maopika for this reason, the customer will be required to pay new shipping costs for a return shipment.
  • If the package is lost or permanently undeliverable due to an incorrect address provided by the customer, no refund can be claimed.

Delivery times and delays

Delivery times are provided for informational purposes only and vary depending on the destination and carrier.
The average delays observed are as follows:

  • Metropolitan France: 5 to 10 business days after shipment.
  • European Union: 7 to 15 business days after shipment.
  • International outside the EU: 15 to 30 business days after shipment.

A reasonable delay shall not give rise to any refund or cancellation of the order.
Any delay of less than 15 days for mainland France, 20 days for Europe, and 30 days for international destinations is considered reasonable and does not entitle the customer to any compensation or cancellation.
Beyond these deadlines, the customer may report an abnormal delay in accordance with the following terms and conditions.


Issues related to tracking and delivery

  • The customer is responsible for regularly checking the status of their package using the tracking number provided at the time of shipment.
  • In the event of an anomaly (unusual delay, package marked as delivered but not received, tracking blocked, etc.), the customer must inform Maopika within a maximum of 7 days from the last update available on the carrier's tracking system. After this period, no claims will be accepted.
  • Maopika will take the necessary steps with the carrier, but the customer agrees to actively cooperate, in particular by:
    • By contacting the post office or local delivery service,
    • Checking with neighbors or the building superintendent,
    • And, if necessary, by completing a declaration on honor provided by Maopika.
  • In the absence of cooperation, no request for refund or return can be processed.

Transfer of risks

  • For consumers, the risks of loss or damage are only transferred when the customer physically takes possession of the products.
  • For professionals, the transfer of risks takes place as soon as the package is handed over to the carrier, unless this carrier has been chosen by Maopika.

Clause n° 7 : International shipping and customs

In the event of an order to a country other than mainland France, the customer is considered to be the importer.
Customs duties or local taxes may apply and are the sole responsibility of the customer.
Delays may occur due to customs inspections.

Clause n°8 : Specific conditions for United States

For all orders shipped to the United States, special conditions apply:

  1. Additional tax
    A flat-rate tax of 15% is automatically added to the order amount (products + shipping costs) as soon as the delivery country “United States” is selected.
    This tax is only visible when viewing the shopping cart and confirming the order.
  2. Exclusive delivery method
    Shipments to the United States are handled exclusively by FedEx, with the DDP (Delivered Duty Paid) option.
    This option means that all import duties and taxes are paid by Maopika at the time of shipment. The customer therefore has no additional costs to pay upon delivery.

Clause n°9 : Right of retraction and returns

In accordance with the Consumer Code, the customer has a period of 14 calendar days from receipt to exercise their right of withdrawal.
Return policy:

  • Products need to be returned new, unused, clean, and complete, in their original packaging.
  • Any item returned incomplete, damaged, used, or soiled will not be accepted or refunded.
  • Return shipping costs are the responsibility of the customer.
  • In the event of retraction, Maopika will refund the price of the product as well as the initial standard delivery costs (excluding express delivery surcharges).

Custom or personalized orders cannot be returned, except in the case of a defect that has been identified and acknowledged by Maopika.

Refunds will be issued within 14 days of receiving the returned product or proof of shipment.

Clause n°10 : Legal warranties

The products are covered by legal warranties:
Legal warranty of conformity (Articles L.217-4 et seq. of the Consumer Code) for 2 years,
Legal warranty against hidden defects (Articles 1641 et seq. of the Civil Code).
In the event of a defect in a product sold, it may be partially or fully refunded if the defect prevents the product from being used.
In the event that Maopika decides to send a new product, the defective product must be returned to the seller in order to proceed with the exchange. The return shipping costs will then be borne by Maopika if the defect is recognized.

The defective product must be returned as it was received (clean product, carefully packaged, etc.), otherwise the seller may request compensation. All complaints, exchange requests, or refund requests must be made electronically to the following address: contact@maopika.com within thirty days of delivery.

Clause n°11 : Mediation

Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law. Any dispute or complaint must be submitted to our customer service department at this email address contact@maopika.com as a matter of priority in order to reach an amicable solution.

In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, the company has set up a mediation system for customers.
The mediation entity chosen is: CNPM – MEDIATION – CONSOMMATION.

Clause n° 12 : Responsibility

Maopika cannot be held liable for indirect or immaterial damage or damage resulting from misuse of the products. The customer is responsible for the use they make of the products and undertakes to comply with the safety and usage instructions provided.

In the event of force majeure (strikes, natural disasters, blockades, transport issues, etc.), Maopika's obligations are suspended for the duration of the event, and no refund or compensation may be claimed for delays related to these circumstances.
Maopika cannot be held liable for any damage related to the use of the Internet (failure, viruses, loss of data, intrusion).

Clause n° 13 : Copyright

The designs, photographs, texts, logos, and models featured on the website are the exclusive property of Maopika.
Any reproduction or use without written permission is prohibited.
No one is authorized to copy, exploit, redistribute, or use for any purpose or whatsoever, even partially, elements of the site, be they software, visual or audio. Any simple link or hypertext link is strictly prohibited without the express written consent of Marie Allardon.

Clause n°14 : Personal Data

The information collected is used solely for the purposes of order management, delivery, and billing. GDPR compliance.

Clause n°15 : Langue et droit applicable

These Terms and Conditions are written in French and are subject to French law.
In the event of translation, only the French version shall be deemed authentic.
